The findings of the Commonwealth Study on International Arbitration and the CISG (Lecture by Prof. (Dr.) Petra Butler)
On February 10, 2020, the Centre organised a lecture by Prof. (Dr.) Petra Butler on the Commonwealth Secretariat’s International Commercial Arbitration Study, covering inter alia the use and importance of International Commercial Arbitration in the Commonwealth, and the issues that may hinder it. The session concluded with a question and answer session with the students. It was an engaging and fruitful discussion; and a great learning experience for all those who attended.
Recognition and Enforcement of International Arbitral Awards (Lecture by Mr. Gary Born and Ms. Dharshini Prasad)
On October 15, 2019, the Centre organized a lecture by Mr. Gary Born (Partner) and Ms. Dharshini Prasad (Senior Associate) from the International Arbitration Practice Group, Wilmer Cutler Pickering Hale and Dorr LLP, London via video-conference to address the students on the topic, ‘Recognition and Enforcement of International Arbitral Awards.’ Mr. Born and Ms. Prasad addressed the students for about an hour discussing important provisions of United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards, 1958, also known as the New York Convention.
Careers in Arbitration: (Lecture by Mr. Bharatendu Agarwal, Assistant Director, SAARC Arbitration Council)
On October 06, 2019, Mr. Agarwal spoke to the students about the nature of SAARC Arbitration Council. It is emphasized that SAARCO has been established as a specialized body for settling disputes. The purpose of SAARCO is threefold- first, to act as dispute resolution umbrella under the SAARC mechanism. Second, to be the arbitral institution for disputes arising out of treaties between the member states and third, to research on and develop policies on arbitration as a dispute settlement mechanism. Furthermore, Mr. Agarwal spoke to the students about the employment opportunities SAARCO provides to those intending to pursue international arbitration.
Careers In Litigation: A View From The Bench (Lecture by Hon'ble Justice Madan B. Lokur)
On October 04, 2019, the Centre organised a lecture by the venerable former judge of the Hon’ble Supreme Court of India and a serving judge at Supreme Court of Fiji, Justice Madan Lokur. The topic of the lecture is pertinent and especially significant to have been delivered at the National Law University, Jodhpur, since popular perception is that students are inclined towards corporate careers. Justice Lokur’s views were insightful for the students, since he has voluminous experience at his command from which there is much to imbibe. For more details, please see the report of the lecture.
Selection of Arbitrators in International Investment Arbitration (Lecture by Mr. Rishab Gupta)
On September 18, 2019, the Centre for Advanced Research and Training in Arbitration Law organised a lecture by Mr. Rishab Gupta, Partner at Shardul Amarchand Mangaldas & Co. on "Selection of Arbitrators in International Investment Arbitration”. He spoke about the challenges posed by information asymmetry in the selection of arbitrators, in commercial arbitration and particularly, in investment arbitration. Arbitrator selection hinges as much upon the propensities of arbitrators and factors such as the amount of time they take to deliver awards, which are distinct from professional experience, and rarely above. Such asymmetry, he explained, often disproportionately impacts smaller firms and independent legal practitioners, as they have less access to the informal resources and word of mouth connections that practitioners from bigger firms may have.
Web-Lecture by Prof. Marike Paulsson
On October 02, 2017, the Centre organised a web-lecture by Prof. Marike Paulsson (Director, International Arbitration Institute & Lecturer in Law at the University of Miami, School of Law) on October 2, 2017. Professor Paulsson’s lecture focussed on enforcement concerns associated with the New York Convention.
Annual Arbitration Lectures
CARTAL organizes an annual lecture on arbitration. For 2016, Mr. Ajay Thomas, formerly Registrar of the London Court of International Arbitration (India), was invited to deliver a lecture on the ‘Future of Institutional Arbitration in India’.
Special Lecture Series
The Centre has regularly invited experts to deliver lectures on topical issues in arbitration. Most recently, Mr. Sivaramakrishnan M.S., practising advocate at the Karnataka High Court, delivered lectures on the issue of ‘Joinders, Consolidation and Multi-Party Arbitrations’. Since its inception, the Centre has hosted several distinguished speakers including Prof. Martin Hunter, Mr. Shishir Dholakia, and Mr. Promod Nair.
Round Table Discussion
The Centre has organized round table discussions from time to time. In 2012, Prof. Martin Hunter chaired a discussion on the topic ‘Can India become the hub of international commercial arbitration’ and, in 2013, Mr. Hiroo Advani led the discussion on ‘Running Arbitration from beginning to end’.
Arbitration Training Workshop
The Centre organized a one-day Arbitration Training Workshop on arbitral procedure and award writing in association with the Chartered Institute of Arbitrators (CIArb) India Branch and Advani & Co. in 2012.
Mediation Training Workshop
CARTAL, in collaboration with BRIDGE Mediation LLC, USA, organized a workshop on mediation in October 2012.
